Dreamworld & WhiteWater World Affiliate Operating Agreement
This Agreement sets forth the complete terms and conditions that apply to participation in the Dreamworld & WhiteWater World Affiliate Partner program. As used in this Agreement, "Dreamworld" means Dreamworld C/- Dreamworld Parkway, Coomera QLD, whilst "WhiteWater World" means WhiteWater World C/-Dreamworld Parkway, Coomera, QLD and "you" means the applicant. "Dreamworld Affiliate Site" means http://www.dreamworld.com.au, the landing website for Dreamworld & WhiteWater World on the World Wide Web, and "your site" refers to the World Wide Web site that you will link to the Dreamworld affiliate site.
1. Becoming a Partner
Dreamworld and WhiteWater World are part of the Tourism, Travel and Entertainment industry and we seek to affiliate with online businesses that are closely aligned with this industry or feature Tourist, Travel & Entertainment products on their website. Other industry businesses are welcome to apply, however approval lies solely at the discretion of Dreamworld and WhiteWater World.
To become a Partner, you must register with Dreamworld and WhiteWater World by completing the Online Application Form. Your submission of the application constitutes your agreement that you have read and agreed to all of the terms and conditions contained in this Agreement.
If Dreamworld & WhiteWater World accepts you as an Affiliate Partner, you will receive an e-mail confirmation within five business days containing your Affiliate Code, user name and password, which will make it possible for you to place links on your site that Dreamworld & WhiteWater World can track.
We may reject your application if we determine (in our sole discretion) that your site is unsuitable for the Affiliate Partner program. Unsuitable wesites include (but not limited) to those that:
- promote sexually explicit or adult orientated materials, including dating services
- promote violence
- promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- promote illegal services or material, including email or internet spamming and hacker practices
- otherwise violate intellectual property rights including where search terms and methodology conflict
with Dreamworld & WhiteWater World
Due to the nature of our business we are very mindful of the content featured on our affiliate partner websites and try to ensure these partnerships will not offend nor be deemed inappropriate by our customers.
2. Your Obligations
As a Dreamworld & WhiteWater Affiliate Partner you agree to actively promote our business on your website through the use of the digital resources available in the Affiliate Resources via Affiliate Login page. This may include (but not limited to) promotional text, business listing or profile, images, banner ads and ticket sales promotion.
Using a unique HTML Affiliate link we forward to you in our confirmation email you will establish links from your website to your affiliate ticket sales page on Dreamworld affiliate website. You agree to actively promote the sales of Dreamworld & WhiteWater World tickets through your affiliate link.
If you should not achieve any sales in the period of six consecutive months, your Affiliate membership shall be temporary suspended. You may apply for the reinstatement of your membership once you are ready to actively sell Dreamworld & WhiteWater World tickets again. If you should not achieve any sales in the period of six consecutive months after your second application, your Affiliate membership shall be terminated indefinitely.
You will be solely responsible for the development, operation and maintenance of your site as well as for all materials appearing on it. Your responsibilities include without limitation all aspects of the technical operation of your site (including the proper formatting of links so as to permit tracking of sales) and ensuring that the content of your site does not violate or infringe the rights of any third party. Dreamworld & WhiteWater World disclaims all liability for these matters and you shall indemnify and hold harmless Dreamworld & WhiteWater World from and against all damages, claims and expenses relating to them.
GST
All Dreamworld & WhiteWater World tickets are inclusive of GST. Where your business is not registered or required to be registered for GST, your commission will be determined on the GST exclusive ticket price.
3. Dreamworld & WhiteWater World Obligations
Dreamworld & WhiteWater World will handle all customer services, including the taking, processing and fulfilment of orders, for customers who follow links from your site to the Theme Parks Gold Coast site. Dreamworld & WhiteWater World will be responsible for tracking all sales that come from links on your site. You will receive a commission which will include GST for each successfully completed transaction total, during a session that originated from such a link. (No credit will be given for cancelled bookings.) Your commission payments will be paid directly into the bank account you nominate in the application.
Commission payments will be made within 14 days of the close of every calendar month. A recipient created invoice will be issued summarising sales and commissions payable for the period. A detailed sales and commission report will be made available online via personal login as part of the program.
4. Term of the Agreement
The term of this Agreement will commence upon Dreamworld’s & WhiteWater World's acceptance of your application and will continue until terminated. Subject to clause 5 below, either party may terminate this Agreement at any time by giving at least 30 days written notice, which may be given by e-mail, to the other party. Commission payments to you in respect to customers who may follow links from your site to purchase tickets after this Agreement is terminated, will not be payable.
5. Modification
Dreamworld & WhiteWater World shall have the right at any time to change or modify the terms and conditions of this Agreement or to impose new conditions. Such changes, modifications or additions shall be effective immediately upon notice thereof, which may be given by any means including by posting on the Dreamworld affiliate site. The absence of notice of termination, which will be effective immediately, by you will constitute your binding acceptance of the change, modification or addition.
6. Relationship of Parties
You and Dreamworld/WhiteWater World are independent contractors, and nothing in this Agreement shall be deemed to create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between us. You do not have the right to accept any offers on behalf of Dreamworld or WhiteWater World or to act for or bind Dreamworld and WhiteWater World in any manner and you shall not make any statement, whether or not on your site, to indicate otherwise.
7. Limitation of Liability
In no event will Dreamworld or WhiteWater World be liable for any indirect, special, or consequential damages arising in connection with this Agreement, your role as a Partner or any item sold under this Agreement.
8. Disclaimers
Other than as required by law, Dreamworld & WhiteWater World make no express or implied warranties or representations with respect to any item sold pursuant to this Agreement or with respect to the operation of the Dreamworld affiliate site.
9. Content
You acknowledge that the Dreamworld affiliate site contains information, data, graphics and other material protected by copyrights and trademarks and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed.
